On November 20, 2024, the FDA’s Digital Health Advisory Committee (DHAC) met to discuss the implications of generative AI in medical devices, particularly those aimed at mental health support. This marked the second meeting focused specifically on AI-enabled content, following a broader discussion earlier in 2024. The committee aims to assess how generative AI can enhance the safety and effectiveness of digital mental health products, which are proliferating in a landscape eager for innovation.

The emerging report from the FDA outlines the regulatory challenges associated with patient-facing AI systems that frequently update and generate new content. Dr. Eriksson pointed out, “There are lots of different biologics, and unless we can pinpoint these biologics, it’s very difficult to find the right intervention.” AI tools could significantly streamline this process, targeting treatments more accurately based on nuanced data analyses.

The FDA officially acknowledges the potential public health benefits that generative AI can offer, particularly in enhancing access to mental health care. Nonetheless, the risks are equally pronounced. Key concerns identified by the FDA include:
